This privacy policy (the “Privacy Policy”) describes the types of information Room and Care, LLC (“R&C”, “we,” “us,” or “our”) may collect from all visitors, users, contributors (“you” or “User”) or that you may provide to us when visiting the RoomAndCare.com website (the “Site”) and/or using our platform’s assisted living listing and search features (collectively with the Site, the “Services”). It also describes our policies and procedures on the collection, use, maintenance, protection, and disclosure of your information when you access and/or use our Services and tells you about your privacy rights and the choices you may have with respect to your Personal Information (defined below). 

 

Please read this Privacy Policy carefully before accessing and using the Services to understand our policies and procedures regarding your information and how we will treat it. If you do not agree with our policies and procedures, your choice is not to use our Services. By accessing and using our Services, you agree to the collection and use of information in accordance with this Privacy Policy. 

Updates

We reserve the right to modify this Privacy Policy at any time by posting an updated Privacy Policy on the Site. We will notify you about any material changes by revising the date at the top of the policy and, we may also, at our sole discretion, provide registered Users with an email notice of those changes. You are responsible for regularly reviewing the Privacy Policy and your continued use of the Services after we make changes is deemed to be acceptance of the updated Privacy Policy. While you are accessing our Site or using our Services, we may ask you to provide us with certain Personal Information (defined below) about you or the Resident (if not you) that is necessary to provide you with our Services and you may also choose to provide us with additional Personal Information. Personal Information may be provided at the time of registering to use our Services or posting material on our Site, and it may include, but is not limited to:

  • Contact Information: first and last name, phone number, mailing address, email address;
  • Accommodation Listings Information: business name, telephone number, address, email address, description and status of the Accommodation Listings;
  • Account information: username and password, profile information, and account activity;
  • Feedback: information you provide through our customer service center, or information that you share with us.
     

Personal Information” means any information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household. 

You also may provide information to be displayed on public areas of the Site, or transmitted to other Users of the Services or third parties. This information is posted on and transmitted to others at your own risk. While all visitors of the Site and Users of the Services must abide by our Terms of Service which limit what they can and cannot do with information gained through the Services, we cannot guarantee that their use of information that you provide directly to them or which is provided to them through the Services will be handled in accordance with this Privacy Policy. 

 

We will not ask or require you to provide sensitive information, such as information related to your finances, health, age, marital status, or any other information not required to provide the Services. We cannot control what information is requested from Registered Providers, or information provided by Residents, while using the Services. Any information you provide to other users of the Services is entirely at your own risk.

 

Personal Information Automatically Collected From You 

While you are accessing our Site or using our Services, we may automatically collect certain information from you. This information may include, but is not limited to: 

  • Your device's internet protocol address (e.g. IP address), browser type and version;
  • Access date and time, pages of our Service that you visit and the time spent on those pages, searches for Accommodation Listings, and other actions while using the Services;
  • Geolocation data, such as the precise or approximate location determined from your IP address;
  • Information about the device you use to access our Services, including the hardware model, the type of mobile you use, operating system and version, unique device identifiers, cookie data;
  • Other diagnostic data.

 

The information we automatically collect from you is only statistical data and does not include personal information, but we may maintain it or associate it with personal information we collect in other ways to help us improve our Services and deliver a better and more personalized service. We use these technologies for a number of purposes, including to enable you to use the Services, facilitate the functioning of and your access to the Services, to better understand how you navigate through the Services, and to detect and prevent fraud.   • Residents (if you are not the Resident) or a person who contacts us seeking Services for a Resident.

We use information that we collect about you or that you provide to us for the purposes set forth below:

 

  • To present our Site and Services to you; 
  • To provide you with news, advertising, special offers, and general information about services we offer that you request from us, and events which we offer;
  • To provide and maintain our Services, including to monitor the usage of our Service;
  • To create and manage your R&C account, including to provide you with notices about your registration as a User of the Services;
  • To carry out our obligations and enforce our rights arising from any contracts entered into between you and us;
  • To communicate with you, including by email, telephone calls, SMS, or other equivalent forms of electronic communication regarding updates or other functionalities of the Services;
  • To manage and respond to your requests and any other communications from you;
  • To detect security incidents and protect against deceptive and illegal activities;
  • To perform data analysis, identifying usage trends, identify and repair errors, and to evaluate and improve our Services and your experience;
  • To comply with our legal obligations and with the law;
  • To evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Information held by us about our Services is among the assets transferred;

  • With other Users. When you share personal information in your account profile, Accommodation Listings or otherwise interact in the public areas with other Users, such information may be viewed by all Users and may be publicly distributed outside.
  • For business transfers. We may share or transfer your personal information in connection with, or during negotiations of, any merger, sale of Company assets, financing, or acquisition of all or a portion of our business to another company.
  • As aggregated information. We may disclose aggregated information about our Users, and information that does not identify any individual, to our advertisers, business partners, or any other third party.
  • To enforce our Terms of Service. We may disclose your Personal Information to enforce and administer our Terms & Conditions.
  • To protect our rights. We may disclose your Personal Information to protect the rights, property or personal safety of R&C, its employees, its members and members of the public.

We may disclose your Personal Information to comply with the law, a court order, law or legal process, including to respond to (a) notices of intellectual property infringement, (b) claims that Property Information violated the rights of third parties, (c) government or regulatory request, and/or (d) investigate the use of or respond to alleged violations or infringement of Third-Party Content.

5. Managing Your Personal Information  

 

You may manage your Personal Information through your account settings. You can also request correction of inaccurate information about you by contacting us at support@roomandcare.com. After receiving proof of your identity, you may request that we delete or change any or all of the information (subject to certain exceptions) and we will respond to your request within thirty (30) days of receipt. You are responsible for keeping your personal information up to date. You may also choose to opt-out of receiving marketing emails and newsletters from us and delete, disable and manage browser cookies, and flash cookies.  

 

Marketing Emails Opt-Out

If you no longer want to receive marketing emails from us, you may click the “Unsubscribe” link in an email, follow the instructions provided in any email we send, or contact us.

 

Tracking Opt-Out 

You can opt out of accepting cookies (or browser cookies) by activating the appropriate setting on your browser or you can set your browser to alert you when cookies are being sent. However, if you disable or refuse, you may not be able to access and use some parts of our Services. We may provide paid services within the Services. In that case, we may use third party service providers for payment processing, such as Stripe. We will not store or collect your payment card details. The information will be provided directly to our third party payment processor whose use of your Personal Information is governed by their privacy policy. We may also provide links to third parties’ websites within the Services, but please note that we have no control or responsibility over their data collection, use and disclosure practices. 9. Children’s Privacy

 

Our Services are intended for adults, not children under the age of 18. We do not intend and we do not knowingly collect Personal Information from children under 18. If you are under 18, please do not use or provide any information on this Site or through the Services or any of its features. All Personal Information collected or received from a child under 18 without verification of parental consent will be deleted.
